Summary:

Order disposing of the one remaining issue which was initially addressed in Interim Order P-1171. In that order, I directed the Ontario Insurance Commission (the OIC) to provide written representations on the factors it considered in exercising discretion to withhold the records at issue from the appellant pursuant to section 49(b) of the Freedom of Information and Protection of Privacy Act (the Act ). I have received the representations of the OIC and have carefully considered them. In the circumstances of this appeal, I am satisfied that the OIC has exercised its discretion in accordance with established legal principles. This is my Final Order disposing of the one remaining issue which was initially addressed in Interim Order P-1171.  In that order, I directed the Ontario Insurance Commission (the OIC) to provide written representations on the factors it considered in exercising discretion to withhold the records at issue from the appellant pursuant to section 49(b) of the Freedom of Information and Protection of Privacy Act (the Act).

 

I have received the representations of the OIC and have carefully considered them.  In the circumstances of this appeal, I am satisfied that the OIC has exercised its discretion in accordance with established legal principles.  Therefore, it is my view that the OIC's decision should not be disturbed on appeal.
